1. General
These terms and conditions shall apply to the use of services provided, produced, or maintained by Alekstra Inc (hereinafter ‘Alekstra’) as they appear in Alekstra’s online services. Where this document refers to Alekstra’s online services (or ‘Service’), the term applies to the online services maintained by Alekstra or Alekstra’s subcontractor whose use is available on the basis of this service agreement.
The Service user may use the online services subject to the level of access granted by the service owner.
In these terms and conditions, the user or owner of the online service is referred to below as ‘the Customer’, irrespective of whether he or she is also the subscription owner. The Customer is a legal or natural person with the right to use the Service under the service agreement.
2. Service agreement and user identification
The agreement shall enter into force when Alekstra provides the Customer with a username and password. The Customer agrees to these terms and conditions by using the Service. The Customer agrees to take due care of his or her personal username and password and to keep them private. The Customer is responsible for ensuring that outsiders do not gain access to the username or password, and the Customer agrees to inform Alekstra if he or she has any cause to suspect that the username or password has been disclosed to a third party. The Customer shall be responsible for the actions performed by means of the username and password until Alekstra has been notified of the disclosure of the username and password to a third party.
3. Customer’s rights and responsibilities
The Customer has the right to use the Service under these terms and conditions for purposes that comply with legislation and generally accepted conventions. The Service is specific to the Customer, and the Customer does not have the right to surrender the right to access the Service to a third party. The Customer is liable for all use of the Service through his or her username and password, and for any damages and costs caused thereby. The Customer is directly liable for any damages or infringements he or she causes to any third parties through the use of the Service.
4. Alekstra’s rights and responsibilities
Alekstra has the right to produce the Service in the manner it sees fit; to change the content, operation, and technology of the Service; and to terminate production of the Service or any components thereof. The copyrights, other intellectual property rights, and additional protected rights to the Service content are owned by Alekstra or a third party. Alekstra has the right to suspend the Service temporarily in order to carry out necessary technical changes or upgrades, or to allow installation, modification, or servicing work on the general telecommunication network. Alekstra is not liable for any inconvenience or damages caused by the above-mentioned or for any damages caused by unavailability of the Web sites or the Web sites being out of service. When Alekstra carries out modification or other service work, Alekstra is not liable for any adjustments or modifications that the Customer may have to make to his or her technical equipment or for the Customer’s technical equipment becoming no longer sufficient for implementation of the Service, nor shall Alekstra be held liable for any other effects on the Customer’s technical equipment following such work.
Under no circumstances is Alekstra liable for any direct or indirect damages caused to the Customer or damages caused by force majeure, or minor defects or deficiencies. Alekstra shall be liable for only those direct damages caused to the Customer through Alekstra’s negligence. The maximum amount of Alekstra’s liability is the amount that the Customer has paid in the course of one month for the Service.
Alekstra has the right to change the Customer’s username and password if they create conflicts or overlaps in Alekstra’s data systems.
5. Other terms and conditions
These terms and conditions are those with the highest priority when applied to the use of the Service, followed by Alekstra General Terms and Conditions.
